AAOA/AASP/AASP Conditions of Use

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE ACCESSING THE REGISTRATION SYSTEM FOR THE BENEFITS OF AAOA/AASP. BY USING THIS REGISTRATION SYSTEM, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, PLEASE DO NOT USE THIS SYSTEM.

 

Please review these Terms regularly, as they may change at any time. By using the Registration system after a change in the Terms, you agree to follow and be bound by the Terms as changed. AAOA/AASP has the right at any time to change or discontinue any aspect or feature of the benefit program, including, without limitation, the content, hours of availability, and equipment needed for access or use of the benefits, or restrict your access to certain benefit features. These Terms of Use apply to all users of the AAOA/AASP benefits, including visitors, advertisers, and members. AASP MEMBER BUSINESSES ARE RESPONSIBLE FOR THE FEES FOR ANY PIN NUMBER THAT THEY ASSIGN. THE MEMBER IS ALSO RESPONSIBLE FOR MAINTAINING THEIR COMPANIES DATA WITHIN THIS SYSTEM TO KEEP IT CURRENT. IF NOT CURRENT THE MEMBER COULD BE BILLED FOR PIN NUMBERS THAT THEY SHOULD HAVE DELETED.

 

 

Consent. By using the registration system, you state that you are over 18 years of age and competent to enter into a contract. If you are installing software for use at or by your employer, you state that you are authorized to enter this contract for your employer.

 

Your Use of the Benefits. You agree to make only lawful use of the benefits, and to use the benefits only in compliance with all federal, state and local laws and regulations and any contract you or your employer may have made with AAOA/AASP, including these Terms. You agree to make no use of the benefits that violates anyone else's rights, including copyright, trademark, trade secret, right of privacy, right of publicity or other rights. Access to the AAOA/AASP Benefit Program is granted as a condition of membership to the entity indicated on the Pin Number Card. Access to the benefits of AAOA/AASP is subject to maintaining a membership in good standing with AASP.

 

Restrictions on Use. Access to the AAOA/AASP benefits and Web Site, other than to portions open to the public, is controlled by individual Pin Numbers. Individuals may not share their Pin Numbers with anyone else or permit their Pin Numbers to be used to provide anyone else with access to non-public portions of the Web Site.

 

Termination. Your failure to comply with the Terms automatically revokes your authorization to use the benefits, and terminates any and all rights granted to you under the Terms. Failure to maintain a Membership in good standing will result in immediate termination of your authorization. Your obligations to AAOA/AASP will continue upon termination of your rights under the Terms, including restrictions regarding the Content, disclaimers, indemnification obligations and liability limitations under the Terms. Upon termination of your rights, you must promptly destroy all information, as well as all copies of any benefit information. If a member is terminated this will also terminate all users under their plan.

 

Violations of Rules and Regulations. We reserve the right to seek all remedies available at law and in equity for violations of the rules and regulations set forth herein, including the right to block access from a particular Internet address to this Web Site.

Indemnification. You agree to assume full responsibility for any use of any information, goods or services offered on, or through the benefits. You understand and agree that AAOA/AASP will not be responsible or liable for any claim, loss or damage arising from the use of any information, goods or services in the benefit program. You agree to defend, indemnify and hold harmless AAOA/AASP and their officers, directors, owners, agents, employees, affiliates, licensees and licensors from and against any and all claims, actions, demands, damages, costs, liabilities, losses and expenses, including reasonable attorneys' fees, arising from or related to your use of the benefits, or your violation of any of the Terms of Use or any applicable law, statute, ordinance or regulation.

 

Security. We use industry-standard efforts to safeguard the confidentiality of all information, regardless of whether it identifies you or not. Our security includes use of firewalls, secure socket layers, and encryption. Your Pin Number is a component of our security system. As such, it is your responsibility to protect it. Do not share your Pin Number with any third parties.

 

Disclaimers and Limitations of Liability. You use these benefits at your own risk to the fullest extent allowed by law. AAOA/AASP makes no representations or warranties of any kind in connection with the benefits, and all content, and all information, and services offered on or through the benefit programs are available, �AS IS.� AAOA/AASP disclaims all express and implied warranties, including but not limited to accuracy, completeness, implied warranty of merchantability, quiet enjoyment, fitness for a particular purpose and non-infringement. AAOA/AASP will not be liable for any loss, injury or damage related to your use of or inability to use the benefits, including without limitation direct, indirect, special, compensatory or consequential damages, lost profits or loss of or damage to property, even if AAOA/AASP has been advised of the possibility of such damages.

Applicable Law and Dispute Resolution.

The Terms will be construed according to the laws of the States of Washington, U.S.A. for AAOA and Virginia, U.S.A. for AASP, without regard to its conflicts of laws principles. Any dispute arising under or relating to the Terms, the Content, the use of the benefits, or any services obtained using the benefits, shall be resolved by a court of competent jurisdiction located in King County, Washington for AAOA and Prince William County Virginia for AASP. Your use of the benefits constitutes your consent to submit to the jurisdiction and venue of the state and federal courts located in Washington or Virginia. In the event of a dispute hereunder, the prevailing party shall be entitled to recover its costs and expenses incurred, including reasonable attorneys' fees.

In the news this week: Some of the biggest names in software remain lax when it comes to fixing security holes reported by third-party brokers. According to a list maintained by TippingPoint's Zero Day Initiative, Microsoft, Novell, Oracle, CA and Hewlett-Packard are among the vendors most tardy when it comes to shipping fixes for known flaws. Those flaws could be used in code execution attacks. Microsoft, for example, has nine & high risk& vulnerabilities on the list. Adobe is opening up some of its Flash formats to developers to encourage coders to make a run time environment consistent for users regardless of device or screen size. Designers are “ecstatic” about the concept, but bothered by the execution, said one designer at Google. Sprint Nextel will merge its struggling WiMax division with Clearwire to create a new $14.5 billion company operating under the Clearwire name, and they getting backing from some larger players, including Intel, which is putting up $1 billion, and Time Warner and Google, which invested more than $500 million each. For cable companies the investment opens the door to offer bundles of service including wireless to compete with AT T and Verizon. Performance problems have forced SAP to delay plans for the volume release of its on-demand suite. Business ByDesign is a suite of ERP (enterprise resource planning) applications for midmarket companies. It is currently in an early beta test phase and SAP officials have said it won’t be able to meet its original goal of selling the product to 10,000 customers generating $1 billion in revenue by 2010. Microsoft has built upon its Popfly mashup tool to fashion a new way for beginners and nonprogrammers to create games. Popfly Game Creator builds on Popfly's current set of mashup and Web page authoring tools to add support for easy creation and sharing of casual games.
